Council of State overturns the 'non-processing' decision for Melih Gökçek

The Council of State has annulled the Interior Ministry's 'non-processing' decision regarding former Ankara Metropolitan Municipality Mayor Melih Gökçek, concerning allegations of 'unjust benefits' obtained through changes in zoning plans.

Accordingly, the file has been sent back to the Ministry for preliminary examination.

The First Chamber of the Council of State addressed the complaint that certain property owners were unjustly profiting through zoning plan changes involving former Mayor Melih Gökçek and municipal bureaucrats of his era.

The previous decision by the Interior Ministry to not process the complaint was deemed unfounded by the Council of State.

The First Chamber emphasized that the available information and documents necessitated a preliminary examination under Law No.

4483 on the Prosecution of Public Officials.

The decision stated that it is essential to meticulously investigate who requested the zoning plan changes, which municipal officials signed during this process, and the compliance of the transactions with the legislation.

As a result of the legal review, the Council of State unanimously annulled the Interior Ministry's 'non-processing' decision to determine whether the plan changes provided individual benefits.

With this decision, the file has been sent back to the Interior Ministry for a detailed investigation of the allegations and preparation of a preliminary examination report.
